WARM SPRINGS BART SITES


330 Land Company was engaged by the landowner of two properties within the Warm Springs Innovation Center Community Plan adjacent to the South Fremont BART Station to process entitlements for a residential project. The sites are currently vacant and had been earmarked by the City of Fremont for hotel and convention use (which is economically infeasible). 330 Land developed a strategy around SB 330 and the Housing Accountability Act to allow for the development of the housing projects in spite of active opposition from city staff. After preparation of an SB 330 Preliminary Application, negotiations with city staff, and a direct appeal to the California Department of Housing and Community Development (HCD) the City has acknowledged that development approval for a housing project is a matter-of-right under the current General Plan.
